Navigating the Slippery Legal Slope of Falls. Falls result in both minor and serious injury types including fatalities. In the healthcare setting, falls occur for multiple reasons. When does a fall constitute malpractice and when is it simply a bad outcome? An expert clinician in falls, Dr. Deanna Gray-Miceli sorts out these issues in a teleseminar for attorneys and legal nurse consultants.
Take the Terror out of Testifying as an Expert Witness. Does the idea of testifying at a deposition or trial give you butterflies? Many legal nurse consultants fear giving deposition testimony. Two experienced expert witnesses share lessons learned from the hot seat.
Death by IV Catheter: Air Embolism and IV Catheter Related Sepsis. IV therapy is often an essential component of medical treatment, yet carries risks that can be life threatening. An air embolism is a medical condition caused by oxygen bubbles in the bloodstream. Death may occur if a large amount of air becomes lodged in the heart, stopping blood flow. The Center for Medicare and Medicaid Services has identified air embolism as one of the preventable “never events” for which reimbursement will be denied. Learn why this condition is such a swift killer, and what should be done to prevent unnecessary deaths. The second never event and killer is an IV catheter-related infection, which causes a high death rate. The presenter discusses the risks, consequences, and preventive aspects of sepsis. She focuses on the liability aspects of both of these conditions.
Death in Seclusion or Restraints. An aggressive man becomes combative. The healthcare providers restrain him by sitting on his chest. Within minutes he is dead. A woman placed in seclusion is to be checked every 15 minutes. She is found dead. The death of a patient is an avoidable tragedy, and one that can stimulate a lawsuit. This program will focus on the appropriate use of seclusion and restraints, and strategies to evaluate a psychiatric nursing malpractice claim involving seclusion or restraints. It is geared to attorneys, legal nurse consultants and healthcare providers. Our speaker is a national expert on the use of restraints.
After the Fall. Older adults are at higher risk of falls and also have a higher rate of poor outcomes. Fractures are a serious consequence of falls in the older population and have significant morbidity/mortality, legal and financial implications. Falls are now classified by Centers for Medicare and Medicaid as “never events”, for which reimbursement will be denied. There are a variety of injuries a person can incur as the result of a fall. An expert orthopaedic nurse will help you bone up on fractures. You’ll understand the complexities of these injuries – how they heal and the types of surgeries commonly used to treat them. You’ll understand the damages- the postoperative complications that can occur, including delirium, surgical site infections, pneumonia, DVT, decubitus ulcers, as well as urinary tract infections. Clinical and legal implications are described.
IV Therapy: Complication or Malpractice? An IV infiltration occurs. Caustic medication leaks out of a needle into the tissues. A piece of plastic catheter floats to the heart. A patient claims that a nerve injury resulted from a blood draw. Is it nursing malpractice? Is it a complication of IV therapy? Learn the answers from an experienced IV therapy expert witness and author. Specific information will be provided to assist in screening an infusion case, and in identifying the crucial elements of the discovery process.
The Acute Abdomen. The “golden hour” right after trauma is the time to achieve the maximum benefit for the trauma patient. Learn the importance of a patient history and physical exam as the basis for prompt surgical referral decisions. Learn what will increase the quality of patient care, reduce complications, improve results and greatly diminish the opportunity for medical malpractice litigation. Identify the standard of care for making surgical decisions in the presence of abdominal injuries.
When the Dream is Shattered: Legal Risks of Labor and Delivery. Obstetrical nursing practice is intertwined with high risk for patient injury. The signs of fetal distress must be quickly detected and acted upon in labor and delivery suites. You will learn to identify the most common sources of obstetrical nursing malpractice, including fetal distress and shoulder dystocia. Is it enough for the staff nurse to tell the obstetrician there is a problem? We will explore issues surrounding the chain of command.
Screening potential medical malpractice claims: from the frivolous to the egregious. What makes a viable medical or nursing malpractice claim? An experienced medical malpractice and negligence attorney will help you spot the claims that potentially have merit- from both the medical and legal perspectives. He will provide tips and pearls for use in the methodical screening of potential malpractice claims, using the elements of negligence as a practical framework. Legal nurse consultants will gain invaluable information that will help them more effectively guide their attorney clients.
From Triage to the Courtroom: Legal Risks in ED Practice. Why is the triage seat in the emergency department the hottest one? How do split second decisions change lives? Learn how the intricacies of the triage role can create or avoid patient injury or allegations of ER nursing malpractice or negligence. You will identify which conditions have narrow windows of opportunity, requiring fast and accurate triage assessment. Christine will explore the interrelationships between nursing practice and the standards of care to illuminate this high paced and high risk area of healthcare. This program will include a focus on standards, competencies, and documentation expected of the triage nurse.
